IRS WARNS of companies that make outlandish claims, usually in local advertising, about how they can settle a person’s tax debt for pennies on the dollar.

An enrolled agent is a person who has earned the privilege of representing taxpayers before the Internal Revenue Service by either passing a three-part comprehensive IRS test covering individual and business tax returns, or through experience as a former IRS employee. Enrolled agent status is the highest credential the IRS awards. Individuals who obtain this elite status must adhere to ethical standards and complete 72 hours of continuing education courses every three years. Enrolled agents, like attorneys and certified public accountants (CPAs), have unlimited practice rights. This means they are unrestricted as to which taxpayers they can represent, what types of tax matters they can handle, and which IRS offices they can represent clients before.

The IRS considers you to be in compliance if you file the last six years of tax returns.  That is all that is required, unless the IRS asks for specific tax years.

No problem!  During your appointment we will ask you to sign a power of attorney (IRS Form 2848) for us to represent you before the Internal Revenue Service.  This form will allow us to access all of your federal tax records, including which tax returns were filed, any wages or 1099’s that were reported under your social security number, along with any stimulus payments received.  If you don’t have any tax records, we can recreate them based on what the IRS has on file.

The IRS will provide a refund for the last 3 years of filed tax returns, if you are due a refund.  The State of Michigan will provide a refund for the last 4 years of filed tax returns.  Refunds older than this period will be forfeited, however if you owe money, of course the government still wants their money no matter what.

The IRS only allows tax returns to be electronically filed for the last 3 tax years, which means returns from the prior years 4-6 will have to be printed and mailed in, but don’t worry we’ll prep everything and even put stamps on the envelopes.  This means older returns may take six months or more to process, and depending if their system shows that you may owe them for any of those years, they will hold up any possible refunds on recent returns that were filed electronically.
